End User License Agreement (EULA) for DriveSociety LLC
Effective Date: April 13, 2026
This End User License Agreement ("Agreement") is a legal agreement between you ("User") and DriveSociety LLC ("we," "us," or "our") for the use of the DriveSociety mobile application ("App"). By downloading or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. License Grant
DriveSociety LLC grants you a personal, non-exclusive, non-transferable, revocable, limited license to use the App on devices you own or control, solely for personal, non-commercial purposes, in accordance with this Agreement.

2. Acceptable Use & UGC Policy
By using the App, you agree NOT to post, transmit, or share any content that:
- Is defamatory, abusive, harassing, threatening, or violates a person's right to privacy.
- Is bigoted, hateful, racially offensive, or discriminatory.
- Is violent, vulgar, obscene, pornographic, or sexually explicit.
- Encourages or provides instructions on self-harm, violence, or illegal activities (including illegal street racing).
- Infringes on the intellectual property rights of any third party.
- Contains spam, unauthorized advertising, or misleading information.
- Impersonates any person, entity, or organization.
You are solely responsible for the content you post on DriveSociety.

3. Moderation and Enforcement
DriveSociety LLC maintains a "Zero Tolerance" policy for objectionable content and abusive behavior.
- Review Rule: Reported content will be reviewed and actioned within 24 hours of receiving a report.
- Reporting Mechanism: You can report any objectionable content or abusive user by tapping the "Report" button on any user-contributed content (including posts, comments, car builds, marketplace items, event submissions, and gallery photos) or user profile within the App.
- Blocking: You have the right to block any user at any time. Blocked users cannot interact with you or view your content.
- Termination: We reserve the right to remove any content or permanently ban users who violate this Agreement at our sole discretion, without prior notice or refund.

4. Subscriptions & In-App Purchases
DriveSociety LLC offers optional paid membership tiers (Turbo and Redline) processed through Apple App Store and Google Play.
- Pricing: Subscription prices are displayed clearly at the time of purchase in your local currency.
- Billing Cycle: Subscriptions renew automatically on a monthly or annual basis unless cancelled prior to the renewal date.
- Cancellation: You may cancel at any time through your Apple ID (iOS) or Google Play account (Android) settings. Access continues until the end of the current billing period.
- Refunds: All refund requests are handled by Apple or Google. DriveSociety LLC does not process refunds directly.
- Restore Purchases: You may restore prior purchases at any time using the "Restore Purchases" feature in App settings.

5. User Content License
By uploading or submitting any content (including photos, posts, garage builds, and comments) to DriveSociety, you grant DriveSociety LLC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content across any media for the purpose of operating and promoting the DriveSociety platform.
You represent and warrant that you own or have the necessary rights to grant this license and that your content does not violate the rights of any third party.

6. Intellectual Property
The App, including its design, code, graphics, logos, and trademarks, is the exclusive property of DriveSociety LLC and is protected by intellectual property laws.

7. Marketplace & Transactions Disclaimers
DriveSociety provides a "Marketplace" feature for users to list vehicle parts and accessories for sale.
- Not a Party: DriveSociety LLC is NOT a party to any transaction between users. We do not handle payments, shipping, or dispute resolution for Marketplace listings.
- "As-Is": We do not verify the condition, safety, or legality of any item listed. All transactions are at your own risk.
- Emissions & Legality: You are solely responsible for ensuring that any car part or modification purchased or sold complies with local, state, and federal laws (including DOT and EPA emissions regulations).

8. Events, Meets & Physical Safety (Assumption of Risk)
DriveSociety allows users to discover and RSVP to automotive events and meets.
- Platform Only: DriveSociety LLC is a platform for discovery, NOT an organizer or sponsor of these events unless explicitly stated otherwise.
- Assumption of Risk: You acknowledge that automotive meets involve inherent risks, including but not limited to vehicle accidents, property damage, and physical injury. YOU VOLUNTARILY ASSUME ALL RISKS RELATED TO YOUR ATTENDANCE AT ANY EVENT DISCOVERED VIA THE APP.
- No Liability: DriveSociety LLC, its officers, and employees are NOT liable for any incidents, citations, injuries, or fatalities occurring during or in transit to/from any event or meet.
- Rules of the Road: You agree to obey all traffic laws. We do not condone or accept liability for reckless driving or illegal street racing.

9. Modifications & Technical Information
The App contains information regarding vehicle modifications ("Builds").
- Entertainment Only: This information is provided for entertainment and documentation purposes. It does not constitute professional engineering or mechanical advice.
- Safety: DriveSociety LLC is not liable for any mechanical failures, safety issues, or voided warranties resulting from modifications you perform based on content seen in the App. "Smart Recommendations" and "Recommended Intervals" provided by the App are for general informational guidance only and do NOT supersede the vehicle manufacturer’s official service manual or the judgment of a certified mechanic.

10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability & Indemnification
- Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVESOCIETY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE APP.
- Indemnification: You agree to indemnify, defend, and hold harmless DriveSociety LLC from any claims, damages, or legal fees arising from your breach of this Agreement or your actions during physical meets/events.

12. Governing Law
This Agreement shall be governed by the laws of the State of North Carolina, United States. Any disputes shall be resolved in the state or federal courts located in North Carolina.
